Candela Ivanhoe – Incentive Offer - Terms and Conditions (25.02.2026)

1. Promoter

The promoter is Salter Brothers – 40 Upper Heidelberg Road (Ivanhoe) Pty Ltd ACN 607 045 812 of 40 Upper Heidelberg Road, Ivanhoe, Victoria (Promoter).

2. Offer

The Promoter may offer an incentive valued up to A$5,000 (Incentive) to eligible purchasers of selected apartments or townhouses in the Candela Ivanhoe development (Development) on the terms set out below.

3. Promotional Period

The Incentive is available only during the promotional period specified by the Promoter. The Promoter may shorten or extend the promotional period where reasonable grounds exist, provided that any such change does not affect contracts of sale entered into prior to the change and operates only prospectively. Written notice of any change will be provided. For the avoidance of doubt, a contract of sale is taken to be entered into on exchange.

4. Eligibility

(a) A person is eligible for the Incentive only if all of the following criteria are met:

  1. The person is a new purchaser from 1 March 2026
  2. the person enters into a valid, unconditional and formal contract of sale for an eligible lot during the promotional period;
  3. the contract is entered into in accordance with all statutory requirements;
  4. the person completes settlement of the contract in accordance with its terms; and
  5. with reasonable notice, the person complies with any reasonable administrative requirements prescribed for the Incentive.
  1. Move-in Whitegoods Package
    A move‑in whitegoods package with a value of up to A$5,000, to be provided in connection with the purchaser taking possession of the relevant lot. The specific items, brands and suppliers included in the package will be determined by the Promoter, acting reasonably, having regard to availability and supply constraints.
  2. Additional Secure Basement Storage
    An additional secure basement storage cage allocated to the purchaser’s lot, valued at A$5,000. Storage cage sizes and configurations may vary.
  1. persons who do not complete settlement for any reason other than as a direct result of the Promoter’s breach of the contract of sale;
  2. persons whose contracts are terminated, rescinded, frustrated, abandoned or unenforceable;
  3. persons purchasing lots expressly excluded from the Incentive by clear designation published by the Promoter.
  4. The Promoter will provide a written notification of ineligibility and a brief explanation of the reasons.

5. Incentive Options

(a) An eligible purchaser may choose one of the following Incentive options, subject to availability as at the date of exchange of the relevant contract of sale:

(b) Only one Incentive option may be selected per lot.

(c) Both incentive options are available in limited quantities and will be allocated on a first valid contract and settlement basis.

(d) The Incentive will be provided only after settlement of the relevant contract of sale.

(e) No Incentive will be provided prior to settlement.

(f) The timing and method of delivery of the Incentive will be determined by the Promoter, acting reasonably.

6. Availability

(a) The Incentive applies to a fixed number of lots specified in promotional material.

(b) Once all Incentives are allocated, no further Incentives will be offered.

(c) If incentives are oversubscribed, allocation will be on a first valid contract and settlement basis.

7. Non-Contractual Offer

Unless expressly incorporated into the executed contract of sale:

(a) the Incentive is separate from and does not form part of the contract of sale;

(b) the Incentive does not vary the purchase price;

(c) the Incentive does not constitute a discount, rebate or reduction in price; and

(d) the Incentive does not create rights enforceable as contractual obligations unless specifically written into the contract.

8. Supplier Warranties and Representations

(a) To the extent permitted by law, the Promoter makes no warranty about the quality, suitability or fitness for purpose of the Incentive.

(b) Any warranty for goods or services forming part of the Incentive is provided by the supplier of those goods or services.

9. Substitution

If an advertised Incentive becomes unavailable, the Promoter may offer a substitute of equal or greater value. The substitute will be selected in good faith and communicated in writing. The substitute will be selected in good faith and, provided it is of equal or greater value, will satisfy the Promoter’s obligations under this Incentive.

10. Tax and Costs

Any liability for taxes, duties or similar charges arising from receiving the Incentive is solely the purchaser’s responsibility.

11. Australian Consumer Law

Nothing in these terms and conditions excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other applicable legislation which cannot be excluded. Subject to those non‑excludable rights, these terms and conditions apply to the fullest extent permitted by law. Where a right or remedy cannot be excluded but can be limited, the Promoter’s liability is limited to resupplying the relevant goods or services forming part of the Incentive or paying the cost of such resupply, at the Promoter’s election.

12. Governing Law

These terms and conditions are governed by the laws of Victoria, Australia, and the parties submit to the jurisdiction of the Victorian courts.
